Partner Terms & Conditions

These Partner Terms & Conditions outline the general framework for working with ZAR Advertising as a CFM — Contact Form Marketing — partner.

They are provided so prospective partners can understand the general relationship, responsibilities, commercial framework and operating principles before submitting a Partner Application.

Important Notice

These Partner Terms & Conditions describe the general framework of the ZAR Advertising Partner Program. They are not the final Partner Agreement.

Submitting a Partner Application does not guarantee acceptance, create a partnership or authorize an applicant to act on behalf of ZAR Advertising. Following application review and acceptance, ZAR Advertising may complete a separate Partner setup process covering applicable account access, permissions, private commercial terms, onboarding information and, where appropriate, a separate Partner Agreement containing more specific commercial, operational and legal provisions.

Definitions

ZAR Advertising“ZAR Advertising”, “we”, “us” or “our” refers to ZAR Advertising, the provider of CFM — Contact Form Marketing.
Partner“Partner” refers to a business or individual approved by ZAR Advertising to participate in the Partner Program. An applicant does not become a Partner merely by viewing these Terms or submitting a Partner Application.
Applicant“Applicant” means a business or individual that has submitted, or is considering submitting, a Partner Application but has not yet been accepted into the Partner Program.
Customer“Customer” refers to a business receiving or purchasing CFM services through an applicable direct or partner-related commercial arrangement.
CFM“CFM” means Contact Form Marketing, the managed outreach service provided by ZAR Advertising.
Customer CampaignA “Customer Campaign” is a CFM Campaign associated with an applicable Customer and, where relevant, linked to an approved Partner relationship after the Campaign has separately passed the applicable ZAR Campaign review/setup process.
Successful SubmissionA “Successful Submission” is a contact-form outreach submission that has been successfully completed through the intended form and supported by the required campaign record and valid after-submission proof according to the applicable CFM process.
Partner Commercial Terms“Partner Commercial Terms” means the private pricing, payment arrangements and other commercial conditions communicated by ZAR Advertising to an approved Partner.
Partner Portal“Partner Portal” means the secure ZAR Advertising area made available to an approved Partner for applicable Partner relationship information, introductions, approved commercial terms, documents, resources, account information and any Customer Campaign information specifically permitted for that Partner.

The Partner Program

The ZAR Advertising Partner Program allows approved Partners to introduce Contact Form Marketing to businesses that may benefit from managed contact-form outreach.

ZAR Advertising provides the underlying CFM operational service according to the applicable Customer Campaign scope.

The Partner Program is intended to allow suitable businesses to introduce CFM without having to build the full research, operator, submission-proof and campaign-execution operation themselves.

Participation in the Partner Program is subject to review and approval by ZAR Advertising.

Approved Partners may receive secure Partner Portal access as part of the applicable Partner relationship. Portal features and Customer Campaign visibility depend on the Partner's approved permissions and relationship context.

Approval as a Partner does not guarantee that every Customer Campaign introduced by that Partner will be accepted.

Application & Acceptance

Partner Applications are reviewed individually.

Submitting a Partner Application does not guarantee acceptance into the ZAR Advertising Partner Program.

ZAR Advertising may review information including:

  • the applicant's business, website and business activities
  • customer profile and existing services
  • intended use of CFM and intended partnership model
  • markets served and proposed customer types
  • other information reasonably relevant to the proposed Partner relationship

ZAR Advertising may accept an application, decline it or request clarification or additional information.

There is no application fee and no monthly or recurring Partner Program membership fee merely for remaining an approved Partner unless a separate written arrangement states otherwise.

Approval of a Partner Application is followed by the applicable Partner setup/onboarding process. This may include creation or confirmation of the approved Partner relationship, Partner Portal access, applicable permissions, private commercial terms and other required documentation.

Application approval alone does not authorize unrestricted Customer Campaign access or authority to make commitments on behalf of ZAR Advertising.

Partner Responsibilities

Approved Partners are expected to:

  • provide accurate information to ZAR Advertising
  • represent CFM accurately and avoid unsupported, misleading or exaggerated claims
  • communicate Customer requirements accurately and use current ZAR Advertising-approved service information where appropriate
  • protect confidential and commercially sensitive information, including private Partner pricing
  • follow the applicable Campaign-review process before making Campaign commitments
  • cooperate reasonably where clarification is required
  • protect Partner Portal credentials and account access
  • access Customer or Campaign information only for the authorized Partner purpose and within the permissions made available
No authority to make unapproved commitments. Participation in the Partner Program does not give a Partner authority to make commitments on behalf of ZAR Advertising unless that authority has been expressly agreed. Partners should not represent a Customer Campaign as accepted until ZAR Advertising has reviewed and accepted that Campaign.

Marketing & Representation

Partners must represent Contact Form Marketing accurately and consistently with current service information provided by ZAR Advertising.

A Partner must not represent CFM as guaranteeing Campaign acceptance or capacity; a particular start or completion date; prospect replies, leads or meetings; customers, sales, revenue or other financial results.

Partners must not publish or communicate private Partner pricing, margins or other confidential commercial information without authorization and must not present unapproved pricing, discounts, commercial terms or Campaign commitments as authorized by ZAR Advertising.

CFM is an outreach execution service — not a guarantee of business outcomes.
We control the outreach process — not the prospect's decision.

ZAR Advertising Responsibilities

For accepted Customer Campaigns, ZAR Advertising manages the applicable CFM operating process within the agreed Campaign scope.

This may include:

  • Campaign review and targeting/feasibility assessment
  • prospect research
  • Customer Prospect Review
  • prospect-data preparation and enrichment
  • a unique personalized message for every prospect
  • manual contact-form outreach
  • submission records and proof
  • Campaign tracking and visibility
  • Follow-Ups where purchased
  • Reply Management where included in the applicable plan

The detailed Customer Campaign process remains subject to the applicable Campaign Terms & Policies and accepted Campaign scope.

Customer Campaigns

A Partner introduction or referral does not automatically create or accept a Customer Campaign.

Each proposed Customer Campaign remains separately subject to ZAR Advertising's applicable request/review, feasibility, capacity, commercial and Campaign setup requirements.

ZAR Advertising may accept, decline or request clarification regarding a proposed Customer Campaign. Acceptance of a Partner into the Partner Program does not mean every Customer Campaign introduced by that Partner will automatically be accepted or started.

Any accepted Customer Campaign remains subject to the applicable Campaign Terms & Policies and agreed Campaign scope.

No Guarantee of Results

ZAR Advertising does not guarantee that a Customer Campaign will produce replies, leads, meetings, customers, sales, revenue or other commercial outcomes.

The number of Successful Submissions represents completed outreach activity according to the applicable CFM campaign criteria. It does not represent guaranteed leads, opportunities or business results.

Campaign outcomes may depend on factors outside ZAR Advertising's control, including prospect relevance, offer strength, targeting, messaging, timing, market conditions and prospect decisions.

Partners are expected to communicate this distinction accurately to their customers.

Partner Commercial Terms

Private Partner Pricing

Partner pricing is provided privately to approved Partners. Partner prices, margins, wholesale rates and private commercial arrangements are not published on the public ZAR Advertising website.

  • no fee to submit a Partner Application
  • no monthly Partner Program membership fee
  • no recurring Partner Program fee simply for maintaining approved status

Customer-Facing Pricing

Unless otherwise agreed as part of a specific Partner arrangement, the Partner determines the price it charges its own customer.

The Partner's customer-facing price is separate from the amount payable by the Partner to ZAR Advertising. ZAR Advertising does not publicly disclose the Partner's private purchase price or margin.

Payment to ZAR Advertising

For an accepted Customer Campaign, ZAR Advertising's applicable Partner amount must be received according to the agreed Partner Commercial Terms before ZAR Advertising begins the applicable campaign work.

A Partner should follow the campaign-review process before making commitments that depend on ZAR Advertising accepting a Customer Campaign.

Refunds — General Principle

Where ZAR Advertising cannot complete applicable purchased campaign volume and a refund or credit is due to the Partner, ZAR Advertising's refund or credit is calculated using the amount actually paid by the Partner to ZAR Advertising for the applicable scope and the applicable undelivered portion of that scope.

It is not calculated using the higher customer-facing amount the Partner may have charged its own customer.

If a Partner establishes its own retail price with a customer but pays ZAR Advertising a separate Partner price, any applicable ZAR Advertising refund is based on the Partner amount actually received by ZAR Advertising.

The Partner's own customer-facing refund, credit or other commercial obligation remains part of the Partner's separate customer relationship unless otherwise agreed in writing.

Follow-Up Refunds

The same principle applies to paid follow-up scope. Where ZAR Advertising cannot complete an applicable paid follow-up volume and a refund or credit is due, the calculation is based on the Partner amount actually paid to ZAR Advertising for the applicable undelivered follow-up portion.

It is not based on the amount the Partner charged its own customer for that follow-up service.

Additional Commercial Documentation

More specific pricing, payment, refund, currency, billing or commercial mechanics may be included in Partner Commercial Terms, onboarding documentation, written commercial confirmations or a final Partner Agreement where applicable.

Customer Relationships

The Partner and ZAR Advertising may each have separate commercial and operational relationships connected to a Customer Campaign.

The Partner manages its own Customer-facing commercial relationship subject to the applicable Partner arrangement, while ZAR Advertising manages its service-delivery and Partner-facing obligations.

A Partner's commercial, referral or introduction relationship with a Customer does not, by itself, grant unrestricted access to that Customer's ZAR account, prospects, proof, replies, contacts or Campaign information.

Any Customer-facing commitments made by the Partner remain the Partner's responsibility unless ZAR Advertising has expressly authorized them in writing.

Confidential Information

Both ZAR Advertising and the Partner should reasonably protect confidential and commercially sensitive information received through the relationship.

Confidential information may include:

  • Partner pricing, wholesale pricing and margins
  • commercial documentation
  • customer information and Customer Campaign information
  • campaign records
  • internal processes, credentials and operational information
  • other non-public business information
Private Partner pricing should remain private. ZAR Advertising's Partner-specific pricing and private commercial terms should be treated as confidential unless ZAR Advertising agrees otherwise.

The Partner may establish and communicate its own customer-facing price according to the approved commercial relationship, but should not disclose ZAR Advertising's confidential Partner pricing or private commercial materials without authorization.

More detailed confidentiality obligations may be included in the final Partner Agreement where appropriate.

Customer & Campaign Data

Partners should provide only Customer or Campaign information they are authorized to share for the intended purpose and should avoid unnecessary sensitive information.

Do not use the public Partner Application to submit sensitive material.

The public Partner Application should not be used to submit passwords/login credentials, private account keys, financial-account credentials, unnecessary Customer lists, sensitive confidential Customer material, large Campaign datasets or other information not specifically requested.

Where Customer lists, Campaign files or other private materials are required after approval, ZAR Advertising may provide an appropriate controlled process.

Partner Portal & Customer Campaign Access

Customer and Campaign visibility in the Partner Portal is least-privilege and permission-controlled. Introducing or referring a Customer does not automatically give the Partner access to all information relating to that Customer or Campaign.

Depending on the approved Partner relationship and permissions, ZAR Advertising may separately permit access to categories such as Campaign progress/summary information, the Live Campaign Sheet, prospects, submission proof, replies or Customer contact information. Permission to access one category does not automatically grant access to the others.

Partner Campaign visibility is generally read-only unless ZAR Advertising expressly provides another authorized action. Partner access does not inherit Customer-only controls such as Flag for Review, Finish Review Early, Customer refresh controls, pause requests or other Customer-specific Campaign actions.

Where a Partner is permitted to view a Live Campaign Sheet, access remains subject to the exact Partner/Customer/Campaign relationship, ZAR permissions and any separate access controls used by the underlying service.

Compliance

Partners are expected to comply with applicable requirements relevant to their own business and activities when promoting or offering CFM.

Partners must not knowingly use, promote or introduce CFM for:

  • unlawful activities
  • deceptive practices or fraudulent schemes
  • malicious activity
  • prohibited content
  • activities that create an unreasonable operational, legal or reputational risk for ZAR Advertising or its customers

ZAR Advertising may decline a Customer Campaign that it determines cannot reasonably be supported.

Acceptance of a Partner does not override campaign-level acceptable-use or feasibility review.

Detailed compliance obligations may be addressed in additional Partner documentation or a final Partner Agreement.

Brand & Materials

ZAR Advertising retains ownership of its name, brand, CFM service materials, operational materials, systems, processes and other ZAR Advertising intellectual property unless otherwise agreed in writing.

Approved Partners may use approved materials for legitimate promotion or explanation of CFM within the scope of the Partner relationship.

Partners should not:

  • modify official claims in a way that creates misleading promises
  • imply ownership of ZAR Advertising or CFM
  • represent themselves as ZAR Advertising
  • present themselves as an employee of ZAR Advertising
  • present unofficial materials as approved by ZAR Advertising
  • use ZAR Advertising branding outside the approved relationship
  • create websites, profiles or materials that could reasonably mislead customers about the identity of the Partner or ZAR Advertising

Any additional brand-use permissions may be provided separately.

Independent Relationship

Participation in the Partner Program does not, by itself, make a Partner an employee of ZAR Advertising.

A Partner operates its own business and manages its own customer-facing activities subject to the applicable Partner arrangement.

A Partner should not claim authority to legally bind ZAR Advertising, enter contracts on behalf of ZAR Advertising or make commitments in ZAR Advertising's name unless such authority has been expressly provided in writing.

Any more specific legal relationship between ZAR Advertising and a Partner may be defined in the final Partner Agreement where applicable.

Program Changes

ZAR Advertising may update aspects of the Partner Program as its services and operating processes develop.

Changes may relate to service features, campaign processes, operational procedures, Partner materials, policies or program structure.

Where appropriate, Partners should be informed of material changes relevant to an active Partner relationship.

More specific notice requirements, where applicable, may be established in a final Partner Agreement or other written arrangement.

Nothing in this section should be interpreted as allowing arbitrary retrospective changes to an already accepted Customer Campaign contrary to its applicable campaign terms.

Suspension or Termination

ZAR Advertising may suspend or end a Partner relationship where appropriate, including for misleading claims, misuse of the ZAR Advertising brand, disclosure of confidential Partner information, unlawful/deceptive conduct, serious policy violations, repeated inaccurate representation of CFM or conduct creating significant risk.

A Partner relationship may also end according to an applicable Partner-specific written arrangement.

Suspension or termination may disable or restrict Partner Portal access and Partner permissions, but does not itself require deletion of the underlying Customer, referral or Campaign records.

Existing Customer Campaigns

Suspension or termination of the Partner relationship does not automatically determine the treatment of Customer Campaigns that have already been accepted or are in progress.

Existing Campaigns, completed work, outstanding financial matters and related obligations are handled according to the applicable Campaign Terms & Policies, accepted Campaign scope, Partner Commercial Terms and any Partner-specific written arrangement.

Service Disclaimer

CFM is a managed outreach execution service.

Campaign outcomes can depend on factors including prospect relevance, Campaign targeting, offer, unique messaging, prospect behavior, timing, market conditions, website conditions and other factors outside ZAR Advertising's control.

ZAR Advertising does not guarantee business outcomes from outreach activity. Successful Submission volume represents documented outreach execution — not guaranteed responses or commercial results.

Final Partner Agreement

These Online Terms Are Not the Final Partner Agreement

They are not the final Partner Agreement.

These Partner Terms & Conditions provide the general framework for the ZAR Advertising Partner Program.

Following Partner Application review and acceptance, ZAR Advertising may provide additional documentation containing applicable Partner pricing, commercial terms, payment procedures, operational requirements, responsibilities, brand-use requirements, confidentiality provisions, Partner Portal permissions/access arrangements, legal terms and other Partner-specific conditions.

Where a separate Partner Agreement is provided, that agreement may contain additional or more specific provisions relating to the Partner relationship.

Nothing on this page should be interpreted as creating a signed Partner Agreement merely because the page has been viewed or a Partner Application has been submitted.
